A Presidential proclamation was published in the Federal Register on January 4, 2012, implementing the World Customs Organization (WCO) amendments to the Harmonized System.
The 2012 Harmonized Tariff Schedule (HTSUS) of the United States amendments will go into effect on February 3, 2012. The USITC has posted a preliminary draft of the 2012 HTS on its web site at: http://www.usitc.gov/tariff_affairs/modifications_hts.htm
In instances where Free Trade Agreement (FTA) and Trade Promotion Agreements (TPA) involve tariff change rules (TCR), parties will use the 2011 TCR until the new rules incorporating the new classifications are published. However, the Certificates of Origin (CO) should identify both the new and the previous tariff numbers, followed by the corresponding "(2011 HTSUS)" or "(2012 HTSUS)" on the CO. The 2011 TCRs will govern the TCR analysis until revised TCRs are published.
